Power of Attorney

A power of attorney (POA) or letter of attorney is a written authorization to represent or act on another's behalf in private affairs, business, or some other legal matter. It is a faculty from one person to another, either a person or any legal entity formed in Ecuador, to act on their behalf. It is also an authorization from a citizen abroad granting another person or legal entity, located in Ecuador, to act on their behalf.  There are two types: be general or special.  A general Power of Attorney allows the agent (person granted the POA) to make all possible legal actions on behalf of the principal/grantor. A special Power of Attorney includes only the specific purposes. It is recommended to act for a back up document (minuta).

REQUIREMENTS:

  • Prescence of principal with an ID;
  • Complete information of agent;
  • Content of the Mandate In case of a general POA, the Consulate will present an example of a mandate ('minuta'). In the case of a special POA, the 'minuta' prepared by an Ecuadorian lawyer must be presentedat the time of the request. Otherwise, you should be clear about the procedure that you delegate to your agent (for example, in the case of buying or selling a property, you should know exactly where the property is located, lot number of land, surface, etc.). The lawyer's 'minuta' is mandatory in cases of trials (preference in Word format).
  • Cash payment is not accepted. It is only possible to pay by a bank transfer. Cost € 60 euros.

Revoking a Power of Attorney

Both types of existing Power of Attorney (general and special) can be revoked at any time. The principal must submit the reference number and date of the Power of Attorney to be revoked. 

REQUIREMENTS:

  • The presence of the principal with his original ID or passport.
  • Information of the POA to revoke (number, notary where it was issued, city of issue, date of issue).
  • Cash payment is not accepted. It is only possible to pay by a bank transfer. Cost € 60 euros.

Permit to leave the country

When a minor leaves Ecuador and during the trip is not accompanied by one of the parents, in all cases, a permit to leave the country is needed.

In the case of possesing 'Patria Potestad', the exit permit document is not necessary for travelling.

REQUIREMENTS:

  • The presence of the father and / or mother who authorizes the trip, with their original passport or identification document.
  • Partida de nacimiento del menor de edad y sus documentos de identidad.
  • Name of the person traveling with the child, airline, date of departure, length of stay, address abroad where the child will remain.
  • Cash payment is not accepted. It is only possible to pay by a bank transfer. Cost € 25 euros with a duration of three months.

A digital copy of an identification document of the parent granting the permit and an identification document of the minor are needed to submit a request.

Affidavits

An Affidavit is an act through which Ecuadorian or foreign citizens express in writing, under oath, acts or facts of which they are certain and / or aware before the Consular authority.

REQUIREMENTS:

  • Presence of the declarant with his identity document.
  • Present the minutes sent by an Ecuadorian lawyer with the content of the document or write the reason for the Declaration.
  • Cash payment is not accepted. It is only possible to pay by a bank transfer. Cost € 25 euros with a duration of three months.

Before sending your application online, you must have a digital copy of an applicant's identification document and the minutes prepared by a lawyer (optional; preference in Word format).

Affidavit of Household Goods

 

To comply with one of the requirements for the tax exemption of household goods, you must approach the Consulate to make an affidavit in which you declare under oath your intention to establish your domicile in Ecuador.

REQUIREMENTS:

  • Digital copy of the identity documents of all family members returning to Ecuador.
  • List with the detailed detail of household goods and work equipment, as well as the unit value of each asset stipulated in dollars and the total value of household goods. Invoices for new items.
  • Vehicle description: chassis and engine number, price and invoice or property title. See attached form.
  • Description of the work team.
